Munich/Leipzig, May 16, 2017 – The market valuation of companies consists of almost 87% intangible assets such as intellectual property rights and industrial property rights. The relevant authorities around the globe such as patent and trademark offices can no longer keep up with the ever growing amount of intellectual property rights. Companies also need to adapt to increasingly shorter innovation cycles, filing more and more patents in a shorter amount of time. In the future, companies will increasingly generate, use, and eventually protect their IP independently.

 

Technologies such as artificial intelligence or blockchain will progressively complement the established protective mechanisms of authorities and companies. Innovation will increasingly be created through customer interaction. Communication will be the foundation and data the substance of new intellectual property. The result will be the death of plagiarism. The joint study “The Future of Intellectual Property” by the trend research institute 2b AHEAD and the Dennemeyer Group offers 28 strategic recommendations for companies that want to exploit the true potential of their intellectual property.

 

“Digitalization will fundamentally change the IP management in the next few years. Technologies such as blockchain or artificial intelligence provide opportunities for companies,” explains Dr. Sevim Süzeroglu-Melchiors, Head of IP Consulting at Dennemeyer Consulting. “Intelligent technologies can support companies with more and more tasks, avoiding to be overwhelmed by the ever increasing amount of IPRs such as patents, trademarks, designs, or utility models.”      

This is one of the findings of the recently published trend study “The Future of Intellectual Property” by the Leipzig-based trend research institute 2b AHEAD ThinkTank and the Dennemeyer Group, the world’s largest full service provider for the IP sector. The study is the first to describe how companies will generate, manage, protect, and exploit intellectual property through the use of technology in the future. However, it also shows how this will put the existing IPR system under pressure. The study offers 28 precise strategic recommendations how IP managers, patent attorneys, and innovation managers across all industries can actively shape their future. The qualitative Delphi method study is based on assessments by selected experts. These experts include scientists, patent attorneys with various areas of industry specialization, innovation managers, and technology providers.

 

 

The change of the IPR system

 

The study concludes: Innovation cycles in companies are becoming shorter while development speed is increasing. Companies launch new products at a much faster pace. In contrast to that, the average patent granting procedure takes 24 to 30 months. This creates a speed gap, putting increased pressure on patent and trademark offices. “If patent and trademark offices do not fulfill the companies’ need for increased speed, these will develop their own solutions. Companies will create parallel systems based on new technologies such as blockchain, causing the IP sector to re-regulate itself.” says Michael Carl, Managing Director Research & Analysis of the 2b AHEAD ThinkTank and one of the study authors.

 

 

Know-how will carry the success of companies

 

One of the key findings of the study is that the essential part of any company’s intellectual property is stored in the heads of its employees. Their know-how will carry the company’s success. Project work and a high staff turnover thus drive digital solutions that can select the necessary know-how in companies better and faster, eventually even storing it reliably as well. “The prerequisite for this is an omni-IP management system. This will allow companies to store, link, use, and eventually further develop knowledge, from know-how to IPR to all other data and information points,” says Dr. Sevim Süzeroglu-Melchiors.

 

 

In the future, new knowledge will be generated during customer interaction.

 

Data will be the foundation of the IP of the future. The customer will become the center of product development. The Internet of Things will open up new possibilities for the collection of customer data. These will make it possible to recognize customer desires, eventually adapting products and services accordingly. By already using these new opportunities of individualization, well-established providers force their competitors to take this step as well. If these do not follow suit, customers will sooner or later view them as irrelevant. Michael Carl explains: “Customers expect individualized products that continuously adapt to their needs. One prerequisite for this is a seamless customer interaction. Customer data will shape the product of the future. Based on intellectual property, there will be a class of products that can no longer be copied.”

 

 

The death of plagiarism

 

In the future, a product will become forgery-proof once the customer data is directly used for and processed in a product, allowing the product to automatically adapt to the situational needs of the customer. Dr. Sevim Süzeroglu-Melchiors: “As customers use and thus further develop products because of and during this interaction, the usage itself will become a protective mechanism.“ Michael Carl adds: “An interactive solution that is valuable to the customer will always be an original. This will be the death of plagiarism.“
